Project Management Contract

ROSEGATE BUILDING CONSULTANTS CO. LTD. (“the Project Manager”)

The Client has requested the Project Manager to perform professional services in relation to:-

The Effective Date of this Agreement shall be the date on which the Project Manager commenced performance of the Services, or

As agreed between the Client and the Project Manager

The Services to be carried out by the Project Manager will be as follows:-

1.        To inspect the site daily (except Sundays & public holidays)

2.        To ensure that the Builders follow the clients agreed plans and drawings.

3.        To ensure that construction proceeds to the agreed schedule, subject to the Builder’s contract.

4.        To inform the client on a weekly basis or more frequently if necessary, on progress of the project, and notify the client when the next stage payment is due to the Builder              

5.        The Project Manager will send digital photos of the project weekly, together with his weekly report, and this will be sent by e-mail or fax.

      6    All communications between the Builders and the Client will

            be through the project manager.

FEES:-

The Fees will be negotiable subject to requirements (+Vat), on a monthly basis. The first payment being due upon the signing of this Agreement and all further payments being payable on the 5^th of every month thereafter.

Payments to be made by Electronic Transfer (at Clients expense) to Rosegate Building Consultants bank account

This Agreement is valid from the date of signatory for …x…months unless an extension is agreed in writing by both parties.

All these fees refer to ‘sites’ within Chonburi Province.  

In the event of the monthly payment fees to the Project Managers being in default by more than 15 days, this Agreement will be automatically considered null & void. The Project Managers will then inform the Builder of this termination.

ADDITIONAL POINTS:-

This Agreement can be terminated by the Client or the Project Managers at any time by giving 30 days advance notice in writing.

The Client is solely responsible for all contracted payments to the Builders, and these payments will be made directly to the Builders by the Client.

This agreement shall be governed and construed in accordance with the laws of the Kingdom of Thailand

This agreement is made in duplicate, both parties retaining one copy, by signing this agreement both parties have read and agreed to the terms listed above.
